Employee Privacy & Biometric Technology

2023 had the second-highest number of BIPA filings in the law’s 15-year history. For the first time since 2021, employment-related complaints outnumbered consumer-related complaints for two consecutive quarters, and AI was at the heart of the issue in most of them.

Can You Dig It? Yes, You Can! But at What Cost?: A Proposal for the Protection of Domestic Fossils on Private Land

This article was published in the Texas A&M Property Law Journal, Vol. 8. It has been one of the publication’s most popular articles since its day of publication.

Abstract: Paleontological resources require similar protections to archaeological resources because the threat of looting, improper excavation, and market demand are analogous. Paleontological resources are responsible for informing much of scientists’ understanding of evolution and the history of the planet, just as cultural property helps to inform the evolution of humanity and culture. Once either object is removed from its original context, there is an immediate and invaluable loss of information that could have illuminated important information about the past.

Repatriation of Dinosaur Bones

This capstone paper navigates domestic and international laws regarding the looting and illicit sales of dinosaur bones. I focus the investigation by looking at two of paleontology’s most notorious legal battles: the repatriation of T. Bataar to Mongolia in 2012 and the illegal sale of Tyrannosaurus Sue in 1990. Valuable lessons can be gleaned by studying the looting and repatriation of these dinosaurs which can be used to better protect both paleontological and archeological finds.

Modes of Accountability for International Human Rights Violations

Economic Sanctions have become the United States’ de facto response to hold nation States accountable for human rights violations, creating a paradox— one of the most common tools in modern American foreign policy is also one of the least effective. Economic Sanctions occasionally cause further harm to a State’s most vulnerable citizens while barely grazing governmental bad actors. To improve accountability of bad actors, the U.S. must make changes to its economic sanctions policy by thoroughly examining failures of previous negotiations, integrate humanitarian exceptions to sanctions, and use diplomacy as an alternative when possible.

SLAPP Out of It: The Future of Protection for Journalists in the EU

Following an increase in violence against journalists, including the assassination of Maltese journalist Daphne Caruana Galizia, a group of European MEPs is called on the EU Commission to promote an anti-SLAPP EU directive, to counter the attempts at silencing investigative journalism. On 11 November 2021, The European Parliament overwhelmingly endorsed a resolution to protect journalists and critical voices from abusive lawsuits, otherwise known as Strategic Lawsuits Against Public Participation (SLAPP). This research paper explores the events that lead to this vote and what the legislation aims to accomplish.
